Reports suggest that Warren, who appears to have been a stay-at-home husband, could receive $2 million a year from his wealthy wife, regardless of whether the couple had a prenuptial agreement.

The revelation comes after it was revealed that Jessica Alba and Cash Warren are "separated" and "moving towards divorce", after being spotted out in public without their wedding rings.

Alba and Warren's marriage may have hit the rocks, but a new report suggests the househusband could be walking out of the marriage with a significant payout.

In conversation with The US Sunlegal expert and family law expert Goldie Schon explained that Warren could receive $2 million a year from Alba because the "Fantastic Four" actress has to pay much more than child support.

Schon, who specializes in complex custody and divorce cases, explains that Warren's chances of leaving their 16-year marriage richer would not be affected by the presence or absence of a prenup, especially given the large disparity in their wealth.

While Alba is the co-founder of The Honest Company, which is valued at $609 million and was once reportedly worth over $1 billion, Warren is a producer who doesn't appear to have worked in the industry since 2015.

"Even if there's a prenuptial agreement, and she keeps what's hers, so the Honest Company, which is quite lucrative, that's not going to stop the issue of spousal support," Schon told the news outlet.

She continued, "We've evolved when it comes to prenuptial agreements, and we've had some very big cases, historically, that have held that prenuptial agreements cannot terminate spousal support between couples who are about to get married."

A legal expert explained a potential clause that could make Warren richer regardless of whether a prenuptial agreement exists.

Schon cited an example, noting that if the purported prenuptial agreement provides that neither Alba nor Warren will receive spousal support, a court may decide that the clause is "conscientious and strike it out and still order spousal support in the same way as if the prenuptial agreement had never didn't exist."

She also noted that the court could conclude that the possible prenuptial agreement, which would have been signed 16 years ago and before Alba made millions with her company, is no longer reasonable.

Also, since their marriage falls under California's long-term marriage rules, there would be no guidelines as to when spousal support should end.

"Spousal support would continue until someone passes or someone goes back to court and tries to terminate it or modify it or terminate it," she continued.

Schon added, "Because it's a long-term marriage, basically the court doesn't have the power to say you're only going to pay spousal support for seven years. Eight years, two years, it doesn't matter. The only two people who can enter into that agreement are the parties."

Earlier this week, reports surfaced suggesting that Alba and Warren had ended their marriage and were headed for divorce.

The "Trigger Warning" actress attended a solo Golden Globes pre-party at the Chateau Marmont in West Hollywood last Saturday, but she wasn't wearing a wedding ring.

Also, when she joined film producer Andrea Iervolino for a night out in Rome last month, she was without her ring, prompting speculation that there was trouble in paradise. Warren was also spotted in Los Angeles without a ring on his left hand.

The 43-year-old actress recently posted a cryptic message on her Instagram account about moving on from things that "make me question my worth."

"2024 cleared the way, 2025 has magic," Alba wrote in a note alongside photos of herself with her daughters and friends.

She added: "My mantra for 2025: If it ruins my peace, it's damn expensive. If it dulls my shine, it has to go. If it makes me question my worth, I'm left with 2024. I enter 2025 focused and fully in to my power."

Despite the fact that she and Warren are rarely seen together, estranged couple reunited to celebrate their son's seventh birthday at Universal Studios last week.

Alba and Warren seem to have lost their love for each other a long time ago, as an old clip of her saying they were more like "roommates" years before the confirmed news of their split has resurfaced.

The actress opened up about her marriage in a July 2021 appearance on Katherine Schwarzenegger's Instagram show, Before, During and After Baby.

"Everything is rosy for two and a half years. But then you become roommates," shared Alba per Page Six. "You're just going through the motions. You have responsibilities. It's a lot of, like, checking boxes, isn't it?"

Elsewhere in the conversation, the "Dark Angel" alum admitted that she often took their partnership for granted.

"We have, like, an obvious friendship, comfort, like, 'you're not going anywhere,' so sometimes you don't treat those people the best, right?" Alba said. "You don't consider their feelings the way you would consider other people's feelings, so I think that's something you have to constantly work on."
